Terms of service

These terms are an agreement between you and me, Saverio Tonon (London, UK), the maker of Spotwell. By creating an account or using the app, you agree to them. Please read them together with the privacy policy, which explains what happens to your data.
1. What Spotwell is
Spotwell is an app for planning and logging workouts, following your progress, and, if you choose, training with a personal coach who uses the app too. Some features are free; others need a PRO subscription.
2. Your health comes first
Spotwell is not medical advice. The app, its exercise library, starter templates, estimates (such as estimated one-rep max) and anything a coach sends you through it are for general fitness purposes only. Talk to a doctor before starting or changing an exercise programme, especially if you have an injury, a medical condition, are pregnant, or haven’t exercised in a while. Stop if you feel pain, dizziness or shortness of breath. You train at your own risk and are responsible for using equipment safely and choosing loads that suit you.
3. Your account
- You must be at least 16 to use Spotwell.
- Give accurate information, keep your sign-in details safe, and tell me if you think someone else has access to your account. You’re responsible for what happens in your account.
- One account per person. Accounts can’t be sold or transferred.
4. Your content
Your workouts, notes, photos, measurements and messages stay yours. You give me only the permission needed to store, sync, back up and show them to you, and to the people you choose to share them with (such as your coach), for as long as you use the app. You can export or delete them at any time in Settings.
Don’t upload anything you don’t have the right to share, anything illegal, or anything that harms or harasses other people.
5. Coaches
Coaches who use Spotwell are independent. They are not employed by me or acting for me, and I don’t check their qualifications beyond the badges described in the app (“Verified” means a certificate was checked; it is not a guarantee). The coaching relationship, its advice and any payment between you and a coach are between you and them. You decide what you share with a coach and can end the link at any time.
If you are a coach, you’re responsible for the advice you give, for having the qualifications and insurance your work requires, and for treating your clients’ data with care and only using it to coach them.
6. Acceptable use
Please don’t:
- break the law, or use Spotwell to harass, threaten or deceive anyone
- try to access other people’s accounts or data, or get around the app’s limits or security
- copy, scrape, resell or reverse-engineer the app or its exercise library
- overload or disrupt the service
You can report or block another user in the app. I may suspend or close accounts that break these terms, and remove content that does.
7. PRO and subscriptions
- PRO and coach plans are sold as auto-renewing subscriptions through the App Store (or Google Play). The price, length and any free trial are shown before you buy.
- Payment is taken by Apple or Google. Subscriptions renew automatically unless you turn renewal off at least 24 hours before the end of the current period, in your App Store or Google Play account settings.
- Deleting your account doesn’t cancel a subscription; cancel it in the store too.
- Refunds are handled by Apple or Google under their rules.
- If a subscription ends, your data is kept; some features become read-only or limited, as described in the app.
- Prices and features may change; a price change applies from your next renewal, with notice as the store requires.
Apple’s standard Licensed Application End User License Agreement also applies to the iPhone app. If it conflicts with these terms, these terms apply, except where Apple’s agreement must take priority.
8. Changes to the app
Spotwell is updated over time: features may be added, changed or removed. If I ever close the service, I’ll give you reasonable notice and a way to export your data first.
9. Ending your account
You can delete your account at any time in Settings → Delete Account; your data is then erased as described in the privacy policy. I may suspend or close an account that seriously or repeatedly breaks these terms, telling you why where I can.
10. Responsibility
I work hard to keep Spotwell reliable and your data safe, but the app is provided “as is”: I can’t promise it will always be available, error-free, or that every estimate is exact. Keep your own export if a record matters to you.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that the law doesn’t allow to be limited, and nothing affects your statutory rights as a consumer. Otherwise, I’m not liable for losses that weren’t foreseeable, for business losses, or for injuries that result from how you choose to train.
11. Changes to these terms
If these terms change, the date at the top changes with it. Material changes will be noted in the app’s release notes; continuing to use Spotwell after that means you accept them. If you don’t, you can delete your account.
12. Law
These terms are governed by the law of England and Wales. If you live elsewhere in the UK or in the EU, you also keep the protection of your local consumer law and can bring a claim in your local courts.
